1. Acceptance of Terms

By creating a ScubaKit account or using the platform, you confirm you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the service.

2. Description of Service

ScubaKit is a cloud-based equipment management and tracking tool designed to help dive shops organise and record equipment maintenance, fault reports, parts inventory, and staff information. ScubaKit is an administrative and organisational tool only.

3. CRITICAL SAFETY DISCLAIMER โ€” READ CAREFULLY

ScubaKit is a record-keeping tool. It is NOT a safety system, inspection service, or equipment certification platform.

ScubaKit does NOT replace the professional judgment of certified dive equipment technicians, divemasters, or instructors. All equipment maintenance, inspection, and safety decisions must be made by appropriately trained and certified professionals.

Service reminders are based solely on dates entered by the user. ScubaKit cannot verify the actual condition of any equipment.

By using ScubaKit, you agree that ScubaKit and its operator bear NO responsibility for equipment failure, personal injury, death, or any loss related to diving equipment, whether or not that equipment was tracked in ScubaKit. The safety of your customers and staff remains entirely your responsibility at all times.

4. Subscription and Payment

ScubaKit costs $24 USD/month after a 30-day free trial. Subscriptions renew automatically. You may cancel at any time. No refund for the current billing period. Pricing may change with 30 days written notice. Payments processed by Stripe โ€” we never store card details.

5. Data and Backup

You own all data you enter into ScubaKit. We do not sell or share your data. While we take reasonable steps to protect your data, we are not liable for data loss however caused. You are responsible for maintaining your own backups of critical records.

6. Acceptable Use

You must not attempt to access other customers data, reverse engineer or resell the software, store illegal content, or interfere with the platform.

7. Limitation of Liability

ScubaKit is provided as-is without warranty. To the maximum extent permitted by law, our maximum aggregate liability is limited to the total amount you paid in the 3 months preceding any claim.

8. Termination

You may cancel at any time by emailing scubakit@kohkooddivers.com. We reserve the right to terminate accounts that violate these terms. Upon termination, data is retained for 90 days then permanently deleted upon request.

9. Governing Law

These terms are governed by the laws of Thailand. Disputes shall be resolved in Thai courts.
